finite reality (2)

living love is happiness

By Kulamarva Balakrishna

(challenging questions are welcome)

Vienna,Sunday,January 6,2008:I have said yesterday
ignorance is infinite,unreal,=mithya=,wild goose chase
known in classic Sanskrit =mriga trishnika=.What is
not comprehensible. On the other hand reality is finite,
comprehensible.Real, mind,it has the form of happiness
which is love. That is what is meant by =sat chit ananda=.
Even before coming to happiness and love,we are
made aware =aum= universal radiating energy,=tat=
that identified, =sat= reality. It is in search of this reality
we approach yoga.So when Patanjali starts teaching
yoga system, be begins his sutras, cryptic statements
meant to be explained by the words =atha yoga
anushasanam= now the teaching of the yoga.It implies
yoga is not his creation,it has been there in use.He
is only elaborating it for students.

In other words the sutras are sub-heads of the whole
system science. These are mile stones. The teacher
and the student walk together from one mile stone
to the next.In the process they cover the distance
by understanding. They mile stones or sutras then
serve as reference points, book marks for memory.
The walking together is an exercise. That is
experiencing the depth of knowledge together
by guru and shishya, teacher and disciple. An
opportunity for interaction and especially for the
student a chance to challenge if he remains
unconvinced.

Yoga system is part of the six darshanas or visionary
system of Hindu intellectuals of the old.The six
are 1)nyaya=logic,2) vaisheshika=identifying
significance,3) samkhya=theory 4)yoga=unity
by practice,5) purva mimansa=investigation into
the veda teachings, and 6) vedanta=the sum total
of the veda teachings. These make three inter-
related couples. Thus yoga is based on samkhya
theory.By logic significance is established.On
the basis of the theory unity is accomplished.
By investigation the essence of the vedas
is derived. Therefore yoga helps us to live the
ultimate philosophy of universal love, which is
the true nature of happiness in classic Hinduism.

Then it is clear yoga is not a circus of any kind.
It is living unity by connecting our lives to the
entire universal nature. All the so called yoga
gurus may or may not have walked all the
miles together or parts with guru or alone. If they
have covered the entire distance they are one
with nature like the Buddha,Shakya simha,
=sarvartha siddha= enlightened one.Without
knowing the whole the knowledge remains
incomplete.Those who advertise without
knowing are not to be trusted and followed.

It is advisable not to obey the silly cash grabbing
or power grabbing gurus.Avoid them.As Leo
Tolstoy wrote only recently believe the Kingdom
of god is within you. That is your awakened mind.
That is the message of yoga, Hindu applied
mind science.(end)

infinite ignorance

media playing the role
of blue films?

By Kulamarva Balakrishna

Vienna,Saturday,January 5,2008:Prof.Dr.Narendra Nayak,
of Mangalore,is the President of the Federation of Rationalist
Associations of India. He works all twenty four hours a day
trying to inculcate a rational attitude among young and old
in all parts of the over populated India, numbering more than
1.2 billion even though the rich middle class there continue
to abort illegally female pregnancies. He has been sending
me reports on how he has been trying to amend individuals.
The latest instance involves a lady, the wife of a Professor
of philosophy, who is suffering from hypertension.Instead
of strictly observing the competent medical treatment
made available to her,she went to a well publicized yogi,
I do not like to identify by name since the identification
only helps to promote such sham shamans, since as a
media monitor I am aware of the implications that only
invite more suffering. After her bad experience, she went
back to her competent medical doctor. This only shows
ignorance has infinite faces.

Since it is all about yoga, let me quote the great soul
who developed the yoga system more than two thousand
odd years ago, known as Maharshi Patanjali. He has
written one hundred ninety six cryptic sentences called
=sutras=on yoga.He has in his second sentence given
the definition for =yoga= as regulating and channelizing
the movements of the mind, just as harnessing the free
flowing river water for irrigation and power generation.
If I get a good lay out for my blogsite, I can give every
day the correct commentary of a single sutra a day
for 196 days. That apart, the same intellectual of the past
has written a monumental work on Sanskrit grammar
known as Mahabhashya.Among the classic Sanskrit
scholars, there is a saying that the reading of this
work is like ruling a country. It is the apt description of
the quality of the work of the sage.

In the introductory part of that work, which is in the
form of question and answer between the teacher and
the taught, the student asks his guru, the teacher, why
he only teaches the right forms of use of the language.
Why can´t he describe the wrong methods so we
can avoid them. The teacher answers the wrong
ways are =infinite= they can not be described.Only
the right paths can be shown. So it is. Ignorance
has infinite faces.Unfortunately, it is the case in
in India. Even if a single individual makes five
mistakes 1.2 X 5 make six billion errors.Imagine
each Indian making some 25 errors a day
how on earth a teacher can go on correcting them?
It is next to impossible to correct. But it is easy to
give the right guide lines. That involves India´s
educational system. If the teachers are taught the
correct system,we can cleanse Indian younger minds
so they can follow the proper way of thinking. It is
indeed a thousand pities that Indian education
system is contaminated by superstitions.
We need to cleanse the system as we clean our
spectacles almost daily to avoid impurities
being shown to our eyesights. If a professor´s
wife can go to a sham shaman for cure, imagine
the fate fo the rest of the mortals. It is impossible
to guide every erring individual. The systems
are developed by the learned sages of thousands
of years before us.We should then heed them
to follow their ways.

If the mass media of India printed and electronic
remain faithful to the facts of life, avoid promoting
shamans,they would work updating information
provided by the education system.Instead, they
tend to play the role of entertainers and thereby
promoting superstitions.My younger sister died
of cow urine therapy promoted by the media. When
I pointed this out to Prof.Nayak,he said a nurse
known to him was also a victim.I took up the matter
with Press Council of India, who eat up their resources
by harassing the complainants. The tabloidation of
the media made it worse than blue film obscenities.
The informative role of the media remains neglected.

The rapid expansion of communication technology
is being misused for relentless advertising by
business on one side and the self seeking shamans
promoting superstitions on the other. This makes the
work of rationalists like Prof.Nayak formidable. When
would media amend itself? Instead of leading, the
media today is led by greed,is following its ignorant
audience catering to the uncultivated raw tastes. No
wonder democracies world wide are racing
down hill (end)

man cart rider

if you rot,marxists, that would
be
a service to the society

By Kulamarva Balakrishna

Vienna,Friday,January 4,2008:
Here is a special correspondent report of The Hindu, only name
not communal, daily of South India for which the publishing
family is especially proud, where today we should be proud to
be not only Indians but world citizens.I am sure the founder
of the newspaper, the late Iyer or the successor Kasturi Ranga
Iyengar would have been proud to consider themselves as
members of the world family.

man cart rider Chief Minister
Buddhadeb Bhattacharjee

Quotefrom the report:Kolkata: Its down-sides
notwithstanding there was no better option under
the present circumstances than pursuing the
capitalist approach for greater industrial
development, West Bengal Chief Minister
Buddhadeb Bhattacharjee said here on Thursday.
“We have to accept capitalism; where is State capital?
(in Kolkata.kb)This is being realistic in a situation where
there is no alternative,” (wake up boy.kb) he said while
addressing an audience on the occasion of the 42nd
foundation day of Ganashakti, the Bengali daily and
mouthpiece of the Communist Party of India (Marxist
-Eunuchs without balls. They could have borrowed them
from Charkravarti Rajagopalachari,who abolished man
carts in Madras more than fifty years ago after his
demise.kb).“We have no model before us to emulate
and have to pave our own way ahead,”(modeling on
capitalism.kb.) Mr.Bhattacharjee said, “our position in
the State with a bourgeois set-up existing at the Centre”
( a pretext.kb) to be able “to forge a tactical line”
(enough of the jargon .kb). Quote end.

This left Marxist fools should know in India, there are
more proletariat candidate aspirants than the proletariat.
So the Marxists, instead of using =armed vote wars=
or =armed struggle= as Naxalites, need to do is to work
with very bourgeois, who work for all sections of the
population. Man cart riding in Calcutta streets make you
no Marxist-Lenist and keeper third class =animal farm=
described by Eric Blair alias George Orwell.

Quote:Biman Bose, secretary of the State Committee of the
CPI(M) and chairman of the Left Front Committee, decried
“the conspiracy hatched against the Left Front and its government
by a section of the media which is bent on pursuing its campaign
of misinformation.” ( You idiot Biman= jetset baby, you need
feed by the journalist´s pipe thrust into your mouth yar kb.)
Quote end.

I am quoting the report to present my readers, as a Marxist
contrast for the great work done by a single foreign woman,
the late mother Theresa, and journalist Dominique Lappierre,
again a foreigner with human quality and heart. Now my advice
to these Marxist-Leninist left garbage, =please do rot, if you do
at least there would be natural fertilizer for the land. That would
be monumental contribution to the society you make.Stop
blaming the media=.(end)

wild is but nature

home made spicy pickles
from wild baby mangoes

By Kulamarva Balakrishna

Vienna,Thursday,January 4, 2008:
(The photos show baby mangoes inside the tent and below
Mrs.Bhageerathi Subba Rao and Mr.Beeluru Subbha Rao
proudly showing off their 70 types of =appe=collection.kb)
Indian mangoes as fruit are known world wide. They are deliciousness
in incarnation. But who knows kid mangoes of India as the best of spicy
herbal pickles? Not London made Patak Pickles but home made by
sari clad kitchen experts. They start with selection of wild tender mangoes
grown in identified centuries old trees that every year in different branches
while self rejuvenating the other branches?A recent three day festival held
in Karnataka wood lands presented some 600 mango families selected
from the region.Farmer, environmentalist journalist Shree Padre attended the
three day festival and made all the inputs for the following feature for which
I am grateful.Similarly development journalist Shivananda Kalave had
personally gathered identified wild baby mango related data of some 300
subspecies to back up the festival deserves special mention and recognition.

In Dravidian languages =appe=appi=abbu=etc are the words to call darling

babies. They also call by this name a species of mangoes meant for spicy

pickling.Andhra Pradesh, Tamil Nadu,Kerala and Karnata states have

wood lands where live even today several centuries old tall mango trees

in the wild.Among them some are identified belonging to the species. From

them, less than 30 day old baby mangoes are picked for pickling.Sari clad

house wives with knowledge of traditions pickle them in ceramic jars

using some half dozen ingredients including natural oils for blending. These

tender mango pickles are used during meal.If Indonesians spread their

food plates with different dishes properly sorted as in =Nasi Gorang=

Indian eating taste is derived by using green tips of banana leaves as

plates. They will have for self help salt, pickle, boiled lentils, and herbal

pastes orderly set for eating main dishes as and when necessary to

enjoy classic six type of taste compositions of a meal.

Well prepared and conserved mango or lemon pickle or both top the taste

into climax. In festivities like ones held by old Maharajas of Trivancore-Cochin

as many as 80 kinds of side dishes are served in a three course vegetarian

meal.First course involves light soury soup, papadam, crisp fried lentil cakes,

and main selected cooked rice.It is followed by the second course covering

lentil soup known as =sambar=and different kinds of curries. This is followed

by an interval serving of sweats in liquid and solid forms. The final third

course has butter milk curry to be concluded with pure fresh butter milk

as drink, comparable to Turkish =ayron= but added with green chillies,

curry leaves and many times green coriander leaves, an accepted means

for promotion of normal metabolism in the vegetarian body.In all traditional

families they have individual favorite kitchen recipes.Know how for these are

transfered by mother in law to the young daughter in law just as the guru

transfers his knowledge to his disciple.

Today,as undivided families gradually disappear, the traditional culture is
preserved by holding festivals to exchange among participants the special
know how.Such a typical three day festival on baby mango pickles was held at
Sagar,Karnataka´s heart of four/five wood land districts was held.As a naturalist
environmental journalist,Shree Padre was a guest visitor. In the festival itself,
some 600 families participated. Some six thousand connoisseurs attended.
The festival was called =midi mavu 07=, meaning baby mango year 2007,
indicating this would be an annual feature in March April every year. This
means next year there may be participants from other three Southern states.
Efforts would be made by the organizers to present traditional kitchen as well,
in addition to the exhibition of baby mango pickles only.

The baby mangoes are selected for their stems which emit when picked,
resin of strong smell are basis of identification and selection of wild mango species.
The resin is the conserver, tincture, used in medicine as well by herbal doctors.
Healers collect them in bottle let them mature. If fresh resin when comes into contact
with human skin, the skin at once develops rupture, into boil and septic ulcer.
When body parts develop such ulcers for whatever causes, the mature tinctures
are used as remedies.

The festival was organized by Mr.Khadika Lakshminarayana Hegde,a modern
naturalist farmer who uses a special type of domesticated chicken as watch dogs
of the farm land. The birds protect themselves, protect farm environment and serve
as attraction.Besides, Hegde has his own model Hegde Farms to guide new farmers
as also runs a naturalists´ agricultural industry producing irrigating systems,
natural fertilizers, farm feeding systems. The festival was the first, for which Mr.Hegde
alone met the bill, in Indian terms more than Rs.300,000/ a fortune, which when
converted to dollars would make be about 8000/ under current exchange rate.

Mr.Hegde had gathered the interested families.Out of them Mr.B.Subba Rao and
his wife Bhageerathi were outstanding because they introduced some 70 sub-species
of the baby mango trees single handedly. They also explained different uses of wild baby
and young raw mangoes in the kitchen.A feat indeed. I am reminded of a
wine cellor I visited in Austria years ago in Steirmark federal province.Besides
good type of pumpkins the region specializes in white and red whines as well as
spirits.A farmer confronted us not only with his choice wine collection but also
some 350 kinds of spirits based on fruits he gathered for his personal museum
of spirits!

Says Mr.Subbarao:= This is only the beginning.I do not know when and how it will
end.Once get the best farmers,we can develop great many spice delicacies which
are disappearing now.=(end)

world without islam?

world can survive islam

By Kulamarva Balakrishna

Vienna,Thursday,January 3,2008
When presenting the Islamic attack on Universal
Declaration of human rights, I had mentioned about
the U.S.American current thinking on Islam and cited
the opinion makers views as presented by the Jan/Feb
issue of the prestigeous Foreign Policy Magazine.
There is no point my reprinting the article. But I
bring the issues before the readers for consideration.
It is no empty talk of nuking the holy sand lands
into molten glass! It is under consideration.Islam
if it does not amend, keeps its choice of exporting
terrorism,it is mistaken. The world has the means
to destroy the =hate holiness= and survive.

Pakistan´s lip service
on fighting terrorism

Ambassador Khan of Pakistan´s articulation of
Islamic Human Rights at the U.N.in Geneva only
serves to show Pakistani co-operation in fighting
terrorism is nothing but a =sham=.I am presenting
only the introductory part of the Foreign Policy
Magazines cover story of the January February
issue.I am aware the readers are intelligent enough
to read and judge.

Introductory text:

A World Without Islam
By Graham E. Fuller

Imagine, if you will, a world without Islam
—admittedly an almost inconceivable state
of affairs given its charged centrality in our
daily news headlines. Islam seems to lie behind
a broad range of international disorders:
suicide attacks, car bombings, military
occupations, resistance struggles, riots, fatwas,
jihads, guerrilla warfare, threatening videos,
and 9/11 itself. Why are these things taking
place? “Islam” seems to offer an instant and
uncomplicated analytical touchstone,
enabling us to make sense of today’s convulsive
world. Indeed, for some neoconservatives,
“Islamofascism” is now our sworn foe in a
looming “World War III.”

But indulge me for a moment. What if there
were no such thing as Islam? What if there
had never been a Prophet Mohammed, no
saga of the spread of Islam across vast parts
of the Middle East, Asia, and Africa?

Given our intense current focus on terrorism,
war, and rampant antiAmericanism—some
of the most emotional international issues
of the day—it’s vital to understand the true
sources of these crises. Is Islam, in fact, the
source of the problem, or does it tend to lie
with other less obvious and deeper factors?

For the sake of argument,in an act of historical
imagination, picture a Middle East in which
Islam had never appeared. Would we then
be spared many of the current challenges before
us? Would the Middle East be more peaceful?
How different might the character of EastWest
relations be? Without Islam, surely the
international order would present a very
different picture than it does today.Or would it?

IF NOT ISLAM, THEN WHAT?

From the earliest days of a broader Middle
East, Islam has seemingly shaped the
cultural norms and..(for further reading get

stopping brahmin
shamanism

is a necessity

By Kulamarva balakrishna

Vienna,Wednesday,January 2,2008:Prof.Sree Sreenivasan
has sent me an article on the declining fortune of brahmins
in India written by Mr.Eric Bellman for the Wall Street
Journal with contributions from Mr.Tariq Engineer. Before
that I have read Vidya Naipaul´s portrait of a Mylapore
brahmin family included in his India A Million Mutinies
Now.I am myself born in a brahmin family.I do not feel any
discrimination even when I go to India or in Europe wherever
I go I am accepted as I am.I mix with all kinds of people
communicate with them on reciprocal basis. No one way
traffic. But in India as in the past brahmins can not expect
respect on the basis of their birth. The caste is no birth right.
Many brahmins have removed their surnames just as the late
Tamil Nadu Chief Minister Kamaraj Nadar removed his non
brahmin = Nadar= from his name. There are problems in
preserving castes as species.Caste must disappear for good.
If brahmins co-operate the society would be growing better
and healthy. It does not help brahmin heads of monasteries of
claimed thousands of years tradition, indulging in crimes and
being caught as under trial as murderous criminals! That
makes life difficult for the government to condone.

But I would advise Mr.Bellman visit Rajasthan, where brahmins
and other gawd men, dressed colorfully like gawd men getting
free passes in buses and other public conveyances. It is all
=shamanism= imported into India from Siberia continuously for
over thousands of years, as India exported Buddhism there.
That time we have about a dozen agnostic, atheist
interpretation of human life. There was non believing Mahaveera
today he has become a gawd. His naked copies of =digambara=
horizon clad sadhus are worshiped. Last year, in Mangalore
a journalist, Mr.B.V.Seetharam was harassed, his office was
destroyed and he himself was jailed at the instance of these rich
obscurantists! Not only Mahaveera, who was naked but also
there was an atheist called Kesha Kambali, the one who dressed
on his own hair as cover. That was more than two thousand years
ago.It is not reality today. We have gotten superficial. We in India
have colors. We love them. But we are so stupid to believe a
monkey devotee, himself becomes gawd like the mini mullahs
become prophets preaching indiscriminate violence against
qafr non believers. In the twenty first century how can we
condone such tribalism leading to unacceptable terrorism?
Brahmin minority unleashed terror should be considered
past. Now we need equality for all.

There are no rights for women in brahminism dominated states.
Female pregnancies are illegally aborted to diminish sex ratio.
Women can not show their faces even in India. Gujarati
Rajasthani women hide their faces just like in mullah countries,
where most of them do not give voting rights to women and
no parliamentary system of democracies exist.Would Eric
Bellman of the Wall Street Journal plead for those living gawd
ruled sand lands? For almost two thousand years brahmins
terrorized India.Should we let them continue now the same
tradition of exploiting and meting out punishment to innocent
humans? I would say get integrated with rest of the humans
you brahmin shamans. Then you will have no causes to complain.
Earlier you give up the identity of separate species, the
discrimination would disappear.Under resistance reverse
discrimination becomes necessary and rather rude.
Brahmins should learn this. They should stop promoting
superstitions in the name of culture(end).

islamist attack u.n

universal human rights
under disguised (terrorist)
attack at u.n.

By Kulamarva Baalakrishna

Vienna,Thursday,January 3,2008
I have a human rights report from Geneva submitted by non
governmental human rights groups. While I reproduce the
conflict report, I draw attention of my readers to the U.S.
Foreign Policy Magazine feature =If Islam were never
founded?=.There is a debate going on in the U.S. about
=nuking= Islamic holy sands into molten glass.Instead the
U.S. and U.K. remain silent considering the U.N. Fora
as an =obscenity= entertainment fora. If sinking
ships like Pakistan are bent on attacking =non-believers=
their belief would not save them.We can only say follow
The United Nations Universal Declaration of
Human Rights
or face de-recognition of
Organization of Islamic Conference.

UN Geneva

The Organisation of the Islamic Conference (OIC) representing
the 56 Islamic States renewed its attack on the Universality of
Human Rights at the 6th Session of the Human Rights Council
that ended on December 14.

On Human Rights Day,December 10, Ambassador Masood Khan,
of Pakistan speaking on behalf of the OIC, claimed that the 1990
Cairo Declaration of Human Rights in Islam
“.. is not an alternative, competing worldview on human rights.
It complements the Universal Declaration as it addresses
religious and cultural specificity of the Muslim countries”.

Not an alternative? But rival. Even a cursory reading of the
Cairo Declaration shows just how widely its definition of human
rights differs from those of the UDHR.No “complementary”
document (the word implies adding to, not subtracting from)
should restrict the rights enshrined in the Universal Declaration.

Yet this is precisely what the Cairo Declaration does. Under
Shari’ah law a woman has no personal autonomy. A women’s
word or the word of a non-Muslim counts as half that of a
Muslim man; and they are valued as half that of a Muslim man.
No woman is considered an autonomous individual but needs
a guardian: her father, husband, son or another male relative,
and may not make autonomous decisions. Freedom of religion
is limited to freedom to become and remain a Muslim.
Apostasy and any actions or statements considered
blasphemous are harshly punished, in some states by death.
Ann Elizabeth Meijer in her classic analysis “Islam and Human
Rights” describes the declaration as not so much a statement
of human rights as a statement of man’s responsibilities towards
God. According to Meyer (p66):

“International law does not accept that fundamental
human rights may be restricted – much less permanently
curtailed – by reference to the requirements of any particular
religion. International law does not provide any warrant for
depriving Muslims of human rights by according primacy to
Islamic criteria.”

In the same speech to the Human Rights Council, Ambassador
Khan said that “The OIC was considering the establishment of
an independent permanent body to promote human rights in
accordance with the provisions of the Cairo Declaration”, and
he referred to a decision taken by the May 2007 Islamic
Conference of Foreign Ministers to work on an Islamic Charter
of Human Rights
, a convention of women’s rights in Islam and
an Islamic Covenant against Racial Discrimination. Not an
alternative?

Our attempted rebuttal

It was disappointing that no delegation was prepared to
challenge the absurdity of Pakistan’s claim. IHEU,
=International Humanistic Ethical Union=collaboration
with one other NGO attempted to do so in the interactive
dialogue the following day but our intervention was ruled
“out of order” and our text stricken from the record.

Unwilling to let the matter rest, I joined David Littman of
the World Union for Progressive Judaism in writing to
Louise Arbour, the High Commissioner for Human Rights
(see full text below) requesting a legal ruling as to whether
the proposed charter based on The Cairo declaration would
conflict with the Universal Declaration.
(See below for the full text.)

The elimination of discrimination based
on religion or belief

On 14 December at the Human Rights Council Pakistan,
again speaking for the OIC, raised objections to the resolution
on the Elimination of All Forms of Discrimination Based on
Religion or Belief. Despite many weeks of work seeking
a compromise with the European Union on this, the OIC had
been unable to accept the right to change one’s religion. This
objection was also raised by Egypt, Malaysia and many other
Islamic states. The resolution also called for the renewal for a
further three years of the mandate of the Special Rapporteur
on Freedom of Religion or Belief. South Africa objected to the
renewal because they found it “inconceivable that her mandate
could be silent on monitoring the role that may be played by
the media in inciting religious hatred”.

In the event none of the states objecting to the resolution
actually voted against – thereby maintaining the myth of
their support for universal human rights. What they did do
was abstain, safe in the knowledge that under the rules of
procedure an abstention is as good as a vote against since to
be adopted any resolution requires a majority of member
states to vote in favour.

Defamation of Religion

In September 2007 the European Union had attempted to
introduce a resolution in the Human Rights Council on the
elimination of discrimination based on religion or belief, but
its introduction was deferred until December in an attempt
by the sponsors to obtain the support of the OIC. Despite
quite intensive negotiations, however, it became clear that
no agreement would be possible. On December 14, the
Pakistani delegate, again speaking for the OIC, said that
differences remained on five important issues, inter alia:
respect for all religions and beliefs, and respect for national
laws and religious norms about the right to change one’s
religion. “Hence, we dissociate ourselves from operative
paragraph 9(a) because of its phrase ‘including the right
to change one’s religion or belief’”. Yet this right is clearly
enshrined in Article 18 of the UDHR to which all but one of
the Islamic states is signatory.

In the event none of the states objecting to the resolution
actually voted against it – thereby maintaining the myth
of their support for universal human rights. What they did
do however was abstain, safe in the knowledge that in order
to be adopted any resolution requires a majority of member
states to vote in favour, and their abstentions were therefore
equivalent to votes against the resolution. Despite this
opposition the resolution was carried by 29 votes to zer0, with
18 abstentions.

Defamation of Religion

On 18 December 2007, the UN General Assembly adopted
a resolution “Combating Defamation of Religions” by 108
votes to 51 with 25 abstentions. Similar resolutions have
been adopted for the past seven years by the old Commission
for Human Rights and by the new Council. This is the first
time, however, that such a resolution had been passed by
the General Assembly. The resolution expresses “deep concern
about the negative stereotyping of religions and manifestations
of intolerance and discrimination in matters of religion or belief”.
But the only religion mentioned by name is Islam. The resolution
also notes with deep concern, “the intensification of the campaign
to defame religions and the ethnic and religious profiling of Muslim
minorities in the aftermath of the tragic events of 11/9/2001”.
It emphasises that whilst everyone has the right to freedom of
expression, this should be exercised with responsibility – and
may therefore be subject to limitations, inter alia “for respect
for religions and beliefs”.

The Western delegations stood firm, however, in their opposition
to this resolution. The Portuguese delegate, speaking for the EU,
explained clearly why:

“The European Union does not see the concept of ‘defamation of
religions’ as a valid one in a human rights discourse. From a human
rights perspective, members of religious or belief communities
should not be viewed as parts of homogenous entities.International
human rights law protects primarily individuals in the exercise of
their freedom of religion or belief, rather than the religions as such.”
Notwithstanding these objections, those opposing the resolution
found themselves on the losing side of a two-to-one majority in
favour. The implications of this resolution for freedom to criticise
religious laws and practices are obvious. Armed with UN approval
for their actions, states may now legislate against any show of disrespect
for religion, however they may choose to define “disrespect”.
The Islamic states see human rights exclusively in Islamic terms,
and by sheer weight of numbers this view is becoming dominant
within the UN system. The implications for the universality of
human rights are ominous.

Letter to Mrs. Louise Arbour, High
Commissioner for Human Rights
20 December 2007

Your Excellency,

Primacy of the Universal
Declaration of Human Rights

The message of OIC Secretary-General, Prof. Ekmeleddin
Ihsanoglu, on the occasion of Human Rights Day has just
come to our attention, and his statement is noteworthy.
It reads, in part:

Respect of Human Rights through effective protection and
promotion of equality, civil liberties and social justice is a
milestone in the OIC Ten Year Plan of Action. In this regard
the OIC General Secretariat is considering the establishment
of [an] independent permanent body to promote Human Rights
in the Member States in accordance with the provisions of the
OIC Cairo Declaration on Human Rights in Islam and to
elaborate an OIC Charter on Human Rights. The OIC is also
committed to encourage its member States to reinforce their
national laws and regulations in order to guaranty strict respect
for Human Right[s].”

On Friday, December 14, I handed to you the two statements
we addressed to the Council on December 11, one concerning
Darfur, the other the primacy of the UDHR. We were however
unable to complete the latter statement because of a procedural
ruling by the President, Ambassador Toru Romulus da Costea,
but it was officially circulated at the plenum with the Secretariat’s
approval.In this statement, we noted:

“We were surprised that Pakistan’s Ambassador Masood Khan,
speaking yesterday morning on behalf of the OIC, claimed that
the Cairo Declaration was “not an alternative competing
worldview on human rights
”, but failed to mention the
shari’a law as “the only source of reference” (articles 24
and 25) in that same Declaration – the shari’a law where
there is no equality between Muslim men and women,
and between Muslims and non-Muslims.”

The Final Communiqué of the Third Extraordinary Session
of the Islamic Summit held in Mecca on 7-8 December 2005
(…) provides a clear message regarding the UN system of
human rights:

“The Conference called for considering the possibility of
establishing an independent permanent body to promote
human rights in Member States as well as the possibility
in preparing an Islamic Charter on Human Rights in
accordance with the provisions of the Cairo Declaration
on Human Rights in Islam and interact with the United
Nations and other relevant international bodies.”

We seriously question whether such a body would be
“complementary” to the Human Rights Council or whether,
given the wording of the Cairo Declaration, it will have
shari’a law as its “only source of reference” and be seen
as an alternative.

On 14 September 2000, in reply to a communication from
the Association for World Education as to the “universality”
of the Cairo Declaration of Human Rights in Islam
(published in Volume II: Regional Instruments, OHCHR,
1997, pp.477-84 of A Compilation of International Instruments),
the legal advisor to the then HCHR replied:

“The Member States which have acceded to and ratified
United Nations Human Rights Conventions remain bound,
under all circumstances, by the provisions of those texts
as well as the erge omnes obligations under customary
international law.”

We are writing to you today to request an official ruling from
your legal advisor as to whether the above official statement
on Human Rights Day by the OIC Secretary General– in regard
to the Cairo Declaration of Human Rights in Islam and a future
“Islamic Charter” based on shari’a law – would clash with the
UDHR and the Universal Instruments (in, A Compilation..
Volume I, 1993).
Please accept our season’s greetings, and our sincere
appreciation for your multifarious efforts in holding to the
highest standards of human rights and in guiding the
international community along that straight and narrow
path toward an appreciation of the universality of the UDHR.
Respectfully,
